Tragic accidents in New York City can result in the sudden and unexpected deaths of our loved ones. In the most populous city in the country, traffic accidents are a daily occurrence. While most motor vehicle accidents are simple “fender benders,” others are fatal. Likewise, when New York residents receive medical treatment, they don’t anticipate problems. However, each year in America thousands of people die due to medical malpractice. When a loved one dies due to another person’s negligence or recklessness, such as in a car accident or due to medical malpractice, New York residents need to understand their options in a potential wrongful death claim.
Many people are so saddened by the loss of a loved one in a tragic situation that they may not be thinking about potential legal options. That is understandable, as there is clearly no legal remedy that will undue the tragic loss. In these types of cases, the surviving family members must prove that: 1) the defendant had a duty to the deceased person; 2) that duty was breached; 3) the actions or omissions of the defendant who had the duty were the actual cause of the deceased person’s death; and 4) the surviving family members suffered loss due to the death.
