Nearly every parent uses a stroller for his or her baby and depends on manufacturers to provide safe products that will not harm children. In 2006, a seven-month old baby girl in New York was almost strangled by one particular stroller. In response to the incident and others – including one death – the manufacturer of that stroller, Peg Perego, recently recalled an estimated 223,000 strollers. These strollers were reportedly made from January 2004 to September 2007.
Peg Perego explained that the strollers the company recalled were created before a voluntary industry standard was established. This standard specifies a certain height between the stroller’s tray and seat. Other manufacturers have recalled strollers due to other defective product concerns, such as falling and choking due to breakable parts that may detach.
Product liability law provides remedies for injuries resulting from defective products such as the strollers above. When a defective product harms a child, parents can file a product liability claim against those responsible for the defective product, which can include the manufacturer and the retailer. Defective product claims have been made for injuries due to improper materials of the product itself, insufficient warnings of the risks associated with the product or mishandling of the product from the manufacturer to the buyer.
