According to the attorney for Metro North train engineer William Rockefeller, his client was in a “daze” at the time of the Metro North train derailment.

Rockefellers condition at the time of the accident has been described as “almost like road fatigue.”  We now know that the train was traveling over 80 mph in an area with a speed limit of 30 mph.  The investigation has also revealed that the brakes were working properly and were not applied until 5 seconds before the derailment. The tragedy was completely caused by human error without any mechanical problems.  According to Governor Cuomo “this seems like a gross mistake and we want to find out exactly why and what and we want to make sure the operator is held accountable for his actions.”
