Uber Accidents: An Overview

Uber Accidents: An Overview

In 2019, Uber released its first-ever Safety Report. It showed that the company completed more than 2.3 billion trips between 2017 and 2018. Not all of those trips went well. In 2017, there were 49 fatal Uber accidents in the United States. In 2018, the number of fatal rideshare accidents increased to 58.

Uber accidents don’t have to be fatal to cause harm. Every year, thousands of people across the nation – and right here in the Bronx – are injured in accidents involving Uber vehicles.

Causes of Uber Accidents in the Bronx

Accidents involving Ubers can happen for a lot of different reasons. However, there are some factors that regularly contribute to these types of collisions.

Distracted Driving: Uber drivers are perhaps the most distracted drivers on the road. Often, drivers have one eye on their phone (checking the app or GPS) while engaging in conversation or searching for a passenger on the side of the road.

Drowsy Driving: Uber drivers aren’t subject to limitations about how long they can spend behind the wheel at one time. After spending hours transporting passengers across the Bronx and into neighboring boroughs, it’s not unusual for a driver to get tired and suffer from fatigue. Fatigued driving is, in many cases, just as dangerous as drunk driving.

Inexperienced Drivers: There are no heightened requirements or certifications required of Uber drivers. So, there’s really no guarantee that an Uber driver is a good driver or has the skills that are required to navigate the Bronx’s busy city streets safely.

Speeding: The faster an Uber driver travels, the more rides they can complete in a day. That means more money in their pocket when all is said and done. Unfortunately, speed is a common factor in car accidents in the Bronx, including those operated for Uber.

Making Unsafe Stops or Turns at Intersections: Often, Uber drivers in the Bronx pick up and drop off passengers at intersections. This can be dangerous, especially if the driver doesn’t give much notice to other motorists on the road that they’re going to be coming to a sudden stop or making a turn.

Keep in mind, Uber drivers aren’t always to blame for the accidents in which their vehicles are involved. Sometimes other factors – including the weather, other motorist negligence, defective vehicles, and road construction – can cause or contribute to these crashes.

Liability For Bronx Uber Accidents and Injuries

Liability for Uber accidents can get complicated. It often boils down to how the Uber driver was using the Uber app at the time of the accident. Here’s a quick overview of who might be on the hook for your injuries, and when.

The Uber Driver

The Uber driver is personally responsible for all injuries and damages resulting from an accident with their personal vehicle when they’re not logged into the Uber app.

The Uber Driver’s Insurance Company

New York state law requires all motorists to have certain minimum levels of insurance coverage on their vehicles. If you’re involved in an accident with an Uber, the driver’s personal insurance policy will likely cover your costs – up to the driver’s limits.

Uber’s Insurance Company

Uber is required to provide insurance coverage for drivers who are logged into the app.

Two different levels of coverage apply, depending on whether or not an Uber driver has accepted a ride request:

  • When a driver is in-between rides, policy limits are $75,000 per injury, $150,000 per accident, $25,000 for property damage.
  • When a driver has accepted a ride request, the policy limits increase – up to $1.25 Million for personal injuries.

Uber also maintains Uninsured Motorist Coverage (UM) in the event of an accident with an uninsured or underinsured motorist.

Note, Uber’s insurance coverage is secondary. This means you have to exhaust other options before seeking benefits from Uber’s policy.

Other Parties and Third-Party Insurers

If someone other than an Uber driver contributes to an accident – like a pedestrian, truck driver, or bicyclist – they can be held financially responsible for the consequences (as can their insurance provider).

Your Insurance Company

If you were in another vehicle that was involved in a collision with an Uber, you’ll be required to turn to your insurance provider for compensation first. New York’s no-fault law explains that if your injuries are severe and your damages exceed your own policy limits, you can then seek additional compensaiton from other parties.
