How Do I Prove Negligence in a Medical Malpractice Case in New York? 

Under New York personal injury laws, the vast majority of medical error cases are based on negligence. The victim has to prove that the at-fault party: (1) owed a duty of care; (2) breached that duty; (3) caused their injuries; and (4) caused damages.

Under the discovery rule, you have:

  • One year from the date you discovered, or reasonably should have discovered, that a doctor left a foreign object in your body
  • Two years and six months after you discovered a doctor’s failure to diagnose cancer (but you have to file within seven years after the mistake in all cases)
