How Can a NYC Mass Tort Lawyer Help If I’ve Been Harmed After Taking Metformin?

Metformin Injury Lawsuits

When a dangerous drug like Metformin hits the market, it has the potential to cause a lot of pain and suffering. In turn, it’s not uncommon for tens of thousands of injury victims to take legal action and file lawsuits against the company (or companies) responsible for manufacturing and selling the dangerous drug.

Often, when this happens, similar lawsuits are consolidated into something called an MDL – or multidistrict litigation.

In an MDL, lawsuits based on similar arguments, facts, and evidence are merged into one singular proceeding that’s overseen by a federal court judge. Unlike class action lawsuits, each plaintiff gets their day in court and has the right to have their individual case litigated before a judge and jury.

Many Metformin lawsuits have already been consolidated into multidistrict litigation actions in federal courts across the United States.

If you are thinking about filing a Metformin lawsuit, there’s a good chance that your case will join one of these actions. Rules and procedures affecting these types of cases are unique.

So, it’s imperative that you work with a NYC personal injury attorney who has experience handling mass tort cases like these.

Metformin: Uses and Dangers

Metformin – a drug commonly marketed under the brands Glucophage, Riomet, and Glumetza – has been widely used as a treatment for Type 2 Diabetes by more than 120 million people across the globe. It’s the number one prescribed Type 2 Diabetes medication, advertised as a way to help patients manage their blood sugar.

However, thanks to recent discoveries by the FDA, it’s also perhaps the most dangerous medication used to treat Type 2 Diabetes.

Testing conducted by the FDA revealed that several batches of the popular prescription drug contained NDMA (N-nitrosodimethylamine) – a known carcinogen. NDMA is classified as a known carcinogen in animals and a possible carcinogen in humans. Simply put – exposure to NDMA can increase the risk of cancer. Studies suggest NDMA is linked to more than more 12 different types of cancer.

Metformin Recalls After Discovery of NDMA

The Food and Drug Administration has announced that several batches of Metformin – manufactured by multiple drug companies – contained levels of NDMA that were “above the acceptable intake limit.”

Shortly thereafter, several pharmaceutical companies with Metformin drugs on the market began to work with the agency to identify the problem and get the unsafe drugs off of the market.

Several Metformin drugs have since been recalled, citing “detection of N-Nitrosodimethylamine (NDMA) Impurity” or NDMA contamination.

Medications affected by the FDA issued recalls include:

  • Time-Caps Labs Inc. (Metformin Hydrochloride for Extended-Release Tablets, USP 500 mg and 750 mg; manufactured by Marksans Pharma Limited)
  • Riomet (Metformin Hydrochloride Oral Solution), 500 mg/5mL; manufactured by Sun Pharmaceutical Industries)
  • Riomet ER (Metformin Hydrochloride for Extended-Release Oral Suspension; manufactured by Sun Pharmaceutical Industries)
  • Bayshore (Metformin Hydrochloride Extended-Release Tablets USP, 500 mg & 750 mg; manufactured by Bayshore Pharmaceuticals, LLC)
  • Lupin (Metformin Hydrochloride Extended-Release Tablets, 500mg and 1000mg ; manufactured by Lupin Pharmaceuticals, Inc.)
  • Granules (Metformin Hydrochloride Extended-Release Tablets USP, 750 mg; manufactured by Granules Pharmaceuticals, Inc.)
  • Apotex Corp (Metformin Hydrochloride Extended-Release Tablets, USP 500mg; manufactured by Apotex Corp)
  • Actavis (Metformin Hydrochloride Extended-Release Tablets, USP 500mg and 750mg; manufactured by Teva Pharmaceuticals USA Inc.)
  • Amneal (Metformin Hydrochloride Extended-Release Tablets, USP 500mg and 750mg; manufactured by Amneal Pharmaceuticals LLC)

Do I Have a Metformin Injury Lawsuit?

The only way to know if you have a legitimate legal claim against a pharmaceutical company is by discussing the details of your case with an experienced mass tort injury lawyer in New York City. You may want to really consider scheduling a free consultation with Rosenbaum & Rosenbaum, P.C. if:

  • You were diagnosed with prediabetic or Type 2 Diabetes
  • You were prescribed Metformin to help keep your blood sugar under control as part of your Type 2 Diabetes treatment plan
  • The specific Metformin medication you were prescribed is one that tested positive for high levels of NDMA

You don’t necessarily have to have been diagnosed with cancer to have the right to file a legal claim against a drug company.

The fact that you know that you’ve been sold a dangerous drug and potentially exposed to a carcinogen can be traumatic. Taking an ineffective drug can do significant damage to your bank account. It’s quite possible that your exposure to NDMA may lead to serious health issues down the line.

There’s no risk in discussing your case and learning about your legal options. Your first case evaluation with our NYC personal injury attorneys is 100% free.

How Much is My Metformin Injury Case Worth?

Every case is different. In truth, the value will ultimately depend on several factors, including:

  • Your present and future medical expenses
  • The severity of Metformin injury
  • Your prognosis and what your road to recovery looks like
  • The emotional and psychological impact your Metformin injury and/or cancer diagnosis has had on you
gavel and cash money

Generally speaking, plaintiffs in Metformin injury lawsuits will be entitled to recover both economic (financial) and non-economic (intangible) damages. This can include the cost of medical care, lost income and wages, emotional distress, mental anguish, and pain and suffering.

If Metformin causes cancer that is ultimately fatal, the victim’s surviving family members can potentially be awarded compensation for their costs and suffering through a wrongful death action.

Pharmaceutical Companies, Dangerous Drugs, and New York Product Liability Laws

Even though drugs like Metformin have to undergo extensive testing to get the FDA’s seal of approval, dangerous medications can still find their way into patients’ hands. The agency can’t be expected to keep tabs on everything and ensure that all products are safe – especially after they’ve been approved by the FDA.

So, states like New York have passed product liability laws to ensure that companies have an incentive to make sure that the products they sell are safe.

Under New York states’ product liability laws, pharmaceutical companies can be strictly liable if the drugs they design, manufacture, or market are defective and cause harm.

Strict liability means that injured Metformin users don’t have to prove negligence. Financial and legal responsibility attaches, regardless of how much care the company used in creating or selling the drug.

Keep in mind that New York limits the amount of time a plaintiff can file a product liability lawsuit against a drug company. Typically, the statute of limitations is three years from the date of injury (or discovering that injury).
