Ny woman files wrongful death suit against treatment center

The loss of a loved one is always difficult. The deceased's presence is greatly missed by their friends and family. Family members must learn to grieve while also sorting through unexpected medical bills and financial losses. When an unexpected death has resulted from another's failures, family members may seek a suit in order to assist them during this challenging time. Recently, a grieving mother filed a wrongful death lawsuit on behalf of her son.

The New York mother filed a lawsuit against a treatment center for using excessive force against her son, which resulted in his untimely death. According to reports, the incident leading to the teenager's death was on a basketball court. The mother claims that several staff members at the non-profit center were grossly negligent and should be held accountable for the negligence and assault in the death of her son.

In a wrongful death lawsuit, family members of the deceased, the plaintiffs, must prove that there was a death of an individual that was a result of another individuals' negligence or intent to cause harm and the family members are suffering monetarily because of the loss of the deceased. In some cases, it must also be shown that a personal representative for the deceased's estate has been appointed. In a wrongful death suit, the surviving family members may receive damages for loss of income, medical expenses and funeral expenses.

Dealing with a loved one's death is always challenging for family members and friends. However, receiving financial assistance for monetary injuries resulting from the loss of a loved one may provide solace for grieving family members.
