Car accident injures two New York women

Automobile accidents occur in New York every day. The accidents are often a result of negligent drivers who are on their cellular phones or fail to use car signals. A car accident resulting in injury can give rise to a personal injury claim depending on the presence of a driver's negligence.

In New York, a nurse aid and her co-worker were severely injured when an SUV driven by an alleged thief crashed into their vehicle. Emergency rescuers used the Jaws of Life to release the women from the wrecked vehicle and rushed them to a nearby hospital. Police claim they were trailing the driver of the SUV at the time of the accident based on a report that the driver had stolen the SUV.

In personal injury claims resulting from car accidents, the court must determine whether the driver was negligent. Some factors courts use to determine whether the driver was negligent are failure to obey traffic signs, speeding and presence of drug or alcohol in the driver's system.

The plaintiff of the personal injury claim holds the burden of proof. The plaintiff must prove that the driver failed to use reasonable care and was therefore negligent, the negligence of the driver was the proximate cause of the accident, the plaintiff was injured and the injury was a result of the accident.

Car accidents due to inattentive and careless drivers are common in New York, and the injuries resulting from accidents can be critical and life changing. Legal claims may provide a financial remedy for the medical bills and loss of income for those injured and their loved ones.
